Terms & Conditions

The information must be read thoroughly and carefully before any booking is made. These terms & conditions are not subject to variation without prior written consent from Theresa Emmerich Kamper.

Once a completed booking form has been accepted by written confirmation by Theresa Emmerich Kamper (here-after to be known as "the company"), all persons named on the booking form (here-after to be known as "the client") will have agreed to a binding contract on the basis of these terms and conditions. If you have any questions regarding these conditions, please do not hesitate to contact us.

 

1. Agreement

​

Any agreement based on the outlined terms & conditions arises upon the fulfilment of the following:

 

a) Receipt by Theresa Emmerich Kamper of a properly completed booking form accompanied by the full payment or deposit specified.

​

b) Clearance of the full payment or deposit (as detailed in Section 2) into the bank account of Theresa Emmerich Kamper.

 

c) The client signing the booking form shall be deemed to sign for themselves or acting as a legally recognised agent of the client for and on their behalf and agrees to make them aware of and abide by these terms and conditions.

 

d) The agreement is between Theresa Emmerich Kamper and the client and is the sole agreement between those parties. No variation of these Terms & Conditions shall be applicable unless agreed in writing by Theresa Emmerich Kamper before the relevant course.

 

e) Theresa Emmerich Kamper reserves the right to refuse bookings to any party or individual without need to give a reason solely at the discretion of Theresa Emmerich Kamper. In such circumstances no agreement arises, and Theresa Emmerich Kamper will return any payment accompanying the booking form.

 

f) Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Company shall be subject to correction without any liability on the part of the Company.

 

2. Payment

 

a) Full payment is required for courses at the time of registration.

 

b) Full payment for sessions run for host schools, museums and other educational establishments, is due no later than 36 calendar days (3 weeks) after submission of invoice, unless otherwise agreed in writing.

 

3. Failure to pay on time

 

a) The amount of each payment shall become due and payable at the expiry of the relevant periods as specified on the invoice. Where the Client falls outside the definition of “small business” under the Late Payment of Commercial Debts (Interest) Act (“the Act”), the Company shall be entitled to charge the Client interest on the amount unpaid at the statutory rate provided by the Act and in other cases charge the Client interest (before as well as after judgment) on the amount unpaid at the rate of 4% over the base rate of Lloyds Bank plc from time to time and compounded monthly and an additional £50 (fifty pounds) handling charge.

 

b) Time of payment shall be of the essence of the contract and the failure of the Client to pay any part of any invoice in due time shall entitle the Company to cancel the Activities and to recover damages for breach of contract by the Client. Such damages shall include, without limitation, any bank charges or other costs or expenses incurred directly or indirectly in connection with the Client’s failure to pay on the due date. The Company shall have authority to re-allocate the Activities without prejudice to any of its other remedies.

 

c) The Client waives all and any future claims and rights of set off against any payment due by the Client under these Conditions and agrees to pay any amounts due regardless of any equity, set off or cross claim on the part of the Client against the Company.

 

d) The rights of the Company under this Clause 3 are cumulative and not alternative and any waiver by the Company of any of its rights shall be without prejudice to any other rights hereunder.

 

4. Cancellation by client on both UK and Overseas Courses

 

Given the substantial preparation by Theresa Emmerich Kamper prior to any course, the client must be aware of the following conditions and therefore agree to such. If the booking is cancelled by the client for any reason the following charges will be applied:

 

a) Cancellation more than 8 weeks before the course starts = Full Refund

b) Cancellation 8-6 weeks before the course start = 50% Refund of Course Cost

c) Cancellation 6-4 weeks before the start of the course = 25% Refund of Course Cost

d) Cancellation less than 4 weeks before the start of the course = NO REFUND

 

5. Cancellation and alteration of courses by Theresa Emmerich Kamper

​

Courses offered by Theresa Emmerich Kamper are, by their very nature, exposed to natural forces (e.g. extreme weather conditions, etc.) and although every effort is made to comply to the course content, Theresa Emmerich Kamper reserve the right to alter the course content to match any natural variables. The client acknowledges that information about courses provided by Theresa Emmerich Kamper is given to the best of the companies’ ability but that because of natural variables it may be necessary to alter of modify a course and that in such circumstances it is not reasonable for Theresa Emmerich Kamper to be liable for any losses as a result and that our liability is limited accordingly.

 

In the event that Theresa Emmerich Kamper cancels a course, all monies will be refunded in full, or if preferred, transferred as a deposit for another course. Please note that Theresa Emmerich Kamper requires a minimum number of 6 clients to run a domestic course and 8 clients to run a course abroad. Theresa Emmerich Kamper reserves the right to cancel all and any booking without reason or notice. Under these very unlikely circumstances Theresa Emmerich Kamper agrees to repay in full all and any deposits or course fees to the client.

 

6. Client conduct

​

Theresa Emmerich Kamper’s clients are expected to behave in a reasonable manner at all times and to comply with the reasonable instructions and leadership of Theresa Emmerich Kamper. Theresa Emmerich Kamper reserve the right to remove any client from the course at the instructors/leader’s absolute discretion without recourse to repayment for that course and against the client(s) will if necessary. Circumstance that may warrant exclusion from the course includes (without limitation): excessive intoxication, use of non-prescription drugs, abusive behaviour, inability to meet the rigours of the course from mental or physical reasons, or through lack of appropriate equipment. If you are in any doubt about your ability to meet the rigours of the course, please contact your GP before booking. For removal of any party under such conditions, Theresa Emmerich Kamper will not be liable to any losses as a result and Theresa Emmerich Kamper is also entitled to any reasonable costs arising from removal of said client(s) payable upon demand. In addition, parents, guardians or those in a position of similar responsibility are to ensure the behaviour and safe control of any children to the satisfaction of Theresa Emmerich Kamper.

No unauthorised fires are allowed without the express permission of Theresa Emmerich Kamper. Even if authorised by Theresa Emmerich Kamper, no fire shall be left unattended at any time and adequate means of fire fighting must be always provided and available at the site of any such fire.

​

The client(s) should be advised that knives, axes and other tools are very sharp and are not to be used on the course without the express permission of Theresa Emmerich Kamper, especially children; Parents/carers/guardians should make their children under their charge fully aware of the risks involved with the above.

​

7. Insurance

​

Theresa Emmerich Kamper is covered to a level of £5,000,000 for Public Liability and is insured as a Bushcraft Skills Provider. Theresa Emmerich Kamper’s clients are advised to provide their own personal insurance cover from a well-established company.

​

8. Liability

 

Theresa Emmerich Kamper’s courses take place in the outdoors, which by its nature is not free from hazards. Whilst every effort is made to minimise risk to clients, the clients accepts that accidents including serious injury and death can occur without Theresa Emmerich Kamper being at fault and accepts to that extent they are taking part in a Theresa Emmerich Kamper course at their own risk. Theresa Emmerich Kamper also take no responsibility for any mishaps occurring as a result of the client’s failure to follow instructions. Theresa Emmerich Kamper only accepts liability for physical injury to a client that is shown to result from negligence on the part of Theresa Emmerich Kamper.

The client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, vehicles, equipment, losses arising on the cancellation of a booking and the expense of delay and harm caused other than by the negligence of Theresa Emmerich Kamper) however arising is not the responsibility of the company and that Theresa Emmerich Kamper’s liability is hereby limited.

The client also recognises attendance of a Theresa Emmerich Kamper course in no way qualifies them to teach the course content. Theresa Emmerich Kamper therefore accepts no responsibility for any mishap occurring to third parties taught by attendees of any of Theresa Emmerich Kamper’s courses.

9. Complaints

​

In the unlikely event that a client has a complaint about a Theresa Emmerich Kamper course, the complaint should be made to Theresa Emmerich Kamper during the event in order that corrective actions can be taken if necessary. Any complaints must be made immediately; Theresa Emmerich Kamper will not accept a complaint after the end of the course. However, should a problem not be resolved at source, a complaint should be made in writing within 28 days. To the extent permitted by law Theresa Emmerich Kamper will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course. Please note all our staff are DBS checked and cleared with the Criminal Records Bureau.

10. Allergies

​

Some of Theresa Emmerich Kamper’s courses are catered. If you suffer from life threatening allergies from substances such as nuts, etc. then we advise you to provide meals for yourself and a reduction to the course costs will be made as a conciliatory measure.

​

11. Consent Form

​

The client acknowledges that they must complete and sign a Consent Form, which must be returned to Theresa Emmerich Kamper at least 2 weeks prior to the commencement of the customer’s course.The consent Form will be emailed to the customer when they make final payment for their course booking.

​

12. Pricing

​

Whilst every effort is made to limit prices to those given on the website and other documentation, Theresa Emmerich Kamper reserves the right to alter prices should the costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials). In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price. In the event of a price increase the client(s) may opt to cancel the booking and will then be entitled to a full refund of all monies paid to Theresa Emmerich Kamper.

 

13. Photography & Video

 

The clients agree that any photographs and video taken during the courses by Theresa Emmerich Kamper or staff may be published on behalf of or included in printed or digital promotional material for the company.

 

14. Change to this agreement

​

Theresa Emmerich Kamper reserves the right to update the Terms & Conditions at any time, without notice.
